Kentucky waiver waitlists: Provider Attestation due January 31, 2027

If someone in your family is on Kentucky's Michelle P. or HCB waiver waitlist, a signed Provider Attestation is due by January 31, 2027 to stay on it.

· Kentucky · This is already in effect.

If your child or family member is waiting for a spot on Kentucky's Michelle P. Waiver or Home and Community Based (HCB) waiver, you now need to confirm they still want that spot. To stay on the waiting list, send in a completed Provider Attestation by January 31, 2027.

What's changing

Kentucky passed House Bill 2 (HB 2) in 2026. It became law over a veto on April 14, 2026. It requires the state to check who is still waiting on some of its waiver waiting lists.

The Department for Medicaid Services (DMS) explained how this works in a letter to providers dated July 24, 2026. It says:

"individuals on the Michelle P. or HCB waiver waiting lists who want to stay on the list must submit a completed Provider Attestation by JANUARY 31, 2027"

That is a direct quote from the DMS provider letter.

The Provider Attestation is a form. It lists:

  • The person's primary diagnosis.
  • The waiver services they need.

It must be signed by one of these:

  • A physician
  • A physician assistant
  • An advanced practice registered nurse
  • A licensed psychologist

The form also has a member authorization part. That authorization expires one year from the day it is signed.

The state will not remove someone just for one missed letter. Before anyone is removed for not responding, the state must make at least three documented attempts to reach them over at least 90 days. After that, the person gets a final 60-day notice.

Who it affects (and who it doesn't)

This affects people on the waiting lists for:

  • The Michelle P. Waiver (MPW)
  • The Home and Community Based (HCB) waiver

It does not affect people who already get waiver services. They keep getting their services.

The letter does not name a verification requirement for the Supports for Community Living (SCL) or Acquired Brain Injury Long Term Care (ABI LTC) waiting lists.
